Sam, I've heard the same thing - that The Republic of Texas has never needed to secede from the Union because we never officially signed on - but have never been able to find conclusive evidence. Even if it were true too many years of tacit approval of the existing condition has created a legal precedent that's probably irrevocable.

Only a few years ago a smallish but spirited group of Texians lay siege to the Capital in Austin claiming that they'd elected the true leader of the Republic, and demanded that Bush resign. They were generally regarded with bemused caution and eventually arrested or dispersed. While some of their claims were technically correct they'd neglected an essential key to successful revolt - obtaining the support of the people. They'd have done well to study Mao.

The mini-revolt was not entirely unprecedented. A similar incident occurred sometime between the end of the War Of Northern Oppression (often erroneously referred to as the "Civil War") and the turn of the 19th-20th centuries. A Republican governor refused to leave office, was besieged and eventually forced out. Texans did not elect another Republican governor until the 1980s when Bill Clements was elected.

Grudges are held closely and long here. Then, eventually forgiven and forgotten long enough to kick boring, nondescript governors upstairs to other positions.
