When I was a newspaper editor, our photographers did not get model releases
for hard news stories, that is, car crashes, plane crashes, bank robberies,
fires, demonstrations, city council meetings, etc. They did, however, get
releases for feature photography. Hard news is in the public interest.
Feature photography is not. There's a famous legal case from years ago about
a black professional in New York City who was photographed on the street,
and whose image was used as a cover on the New York Times Sunday Magazine to
illustrate a story about the black professional class. He took strong
exception to his likeness being used in such a manner, and, as I recall, the
Times had to pull out its checkbook.
