Actually, the blue layer is on the top: http://www.dpreview.com/news/0202/02021102foveonx3tech.asp However, it isn't for the reason you supppose. The very physical/electrical charateristic that makes this sensor possible, that light penetrates and electrically affects silicon at different depths depending on wavelength, determines the order of the layers.
