I believe the rule is that one is suppose to state that the image is an
example only, and that the product may be somewhat different.

English contract law calls this misrepresentation and it is a cause for
contract rescission (i.e. termination).

It is also one of the reasons you can claim under eBay's insurance system.

The real problem is not so much to know your rights but to get them
enforced! If the seller is not willing to get his/her item back and give
your money back, then there is little eBay will do apart from telling you to
claim, and that's up to £150.

So the real trick is to make sure you pay for your goods with a credit card
using PayPal, Billpoint, Minute Pay, Nochex, etc. You will be covered if
things go wrong and your credit card company will credit your account after
they've conducted their investigation. I'm glad to day that in the 400 +
transactions done on eBay, it happened to me only once, and I got all my
money back because I had used a credit card, and kept all original
emails/receipts. I know some within the group don't like eBay, but it
provides a safer transaction environment than newspaper adverts unless you
collect in person.
