The supreme court is not in itself a branch of government. The federal
courts system is the judicial branch and the supreme court is the highest
level of the court system. The courts are regarded as a branch of government
because they have the power in the USA to declare legislation invalid if it
violates the constitutional rights of citizens. Thus, they act as a check on
the power of the legislature and the executive branch.
